Terms and Conditions

Welcome to Earth to Sky Home Photography. These Terms and Conditions govern the use of our photography services. By booking with us, you agree to comply with and be bound by the following terms.

Booking a session with Earth to Sky Home Photography constitutes agreement to these Terms & Conditions.

1. Booking and Payment

Booking Confirmation:
Your booking is confirmed once you receive our confirmation and acknowledge your session.

Payment:
The remaining balance is due within 7 days (1 week) after delivery of your photos and/or iGUIDE. Payments may be made in cash, PayPal, bank transfer, or other accepted electronic methods.

If payment is not received within this timeframe, we reserve the right to restrict access to your iGUIDE and photographs until the balance is paid in full.

Accounts not paid within 7 days may be subject to a late fee of 1.5% per month (18% annually) applied to the outstanding balance until payment is received.

Media Usage:
All photographs, virtual tours, floor plans, and related media remain the property of the photographer until full payment is received. Licensing for use is granted only after payment has been completed.

VAT:
All prices are listed in MXN pesos and include the applicable 16% VAT.

Price Adjustments:
Final pricing is based on our verified measurement of the property's square footage, which takes precedence over builder floor plans, older listings, or other third-party sources.

2. Cancellations & Rescheduling

We understand that schedules can change and are happy to accommodate rescheduling at no additional cost when sufficient notice is provided.

Please provide at least 24 hours’ notice for cancellations or rescheduling whenever possible so we can adjust our schedule accordingly.

Cancellations or rescheduling requests made with less than 24 hours’ notice may be subject to a cancellation fee.

3. Photoshoot Conditions

Property Readiness & Access:
The client is responsible for ensuring the property is clean, staged, and ready for photography, and that the photographer has safe and timely access to the property at the scheduled appointment time. Earth to Sky Home Photography is not responsible for moving furniture, decluttering, or staging the property unless previously agreed upon.

If the property is not ready upon arrival or access cannot be provided at the scheduled time, Earth to Sky Home Photography reserves the right to charge a trip fee, rescheduling fee, or photograph the property as-is if delays would significantly impact the schedule.

Delays:
Delays caused by the client or property readiness issues may result in additional charges or the need to reschedule the session.

4. Image Rights & Usage

Client Use:
Clients are granted a non-exclusive license to use the images, virtual tours, and related media for marketing and promoting the specific property listing.

Photographer Use:
Earth to Sky Home Photography retains the copyright to all images and media and may use them for promotional purposes including website, social media, portfolio, and marketing materials, unless the client requests otherwise in writing prior to delivery.

5. Liability

General:
Earth to Sky Home Photography is not responsible for any damage, loss, or injury occurring during the photoshoot unless caused by gross negligence.

Consequential Loss:
We are not liable for any indirect, incidental, or consequential damages, including loss of business, revenue, or property transactions.

Force Majeure:
We are not liable for delays or cancellations caused by circumstances beyond our control, including but not limited to severe weather, illness, equipment failure, travel disruptions, or emergencies.

6. Privacy & Data Protection

We respect your privacy. Personal information collected will be used only for the purpose of providing requested services and communication related to those services and will not be shared with third parties without consent.

7. Photo Access & Storage

Access Period:
Clients will receive a download link upon delivery and will have 30 days to download their photos and media. After this period, the gallery link may expire.

Storage Policy:
Final images and media are archived for 365 days from the session date. After this period, files may be permanently deleted. Retrieval of images beyond this time cannot be guaranteed and may require scheduling a new session.
