Terms and Conditions

Welcome to Earth to Sky Home Photography. These Terms and Conditions govern the use of our photography services. By booking with us, you agree to comply with and be bound by the following terms.

1. Booking and Payment

  • Booking Confirmation: Your booking is confirmed once you receive our confirmation and acknowledge your session.

  • Payment: The remaining balance is due within 7 days (1 week) after receiving your photos and/or iGUIDE. Payments may be made in cash, PayPal, bank transfer, or other accepted electronic methods. If payment is not received within this timeframe, we reserve the right to restrict access to your iGUIDE and photographs.

  • VAT: All prices are listed in MXN pesos. A 16% VAT applies to electronic payments.

  • Price Adjustments: Final pricing is based on our verified measurement of the property’s square footage, which takes precedence over builder floor plans, older listings, or other third-party sources.

2. Cancellations & Rescheduling

We understand that schedules can change, and we’re happy to accommodate rescheduling at no extra cost. Please provide as much notice as possible so we can adjust accordingly.

3. Photoshoot Conditions

  • Location Readiness: The client is responsible for ensuring the property is accessible and prepared at the scheduled time.

  • Delays: Delays caused by the client may result in additional charges or rescheduling.

4. Image Rights & Usage

  • Client Use: Clients are granted non-exclusive rights to use images and tours for marketing their listing(s).

  • Photographer Use: Earth to Sky Home Photography may use images for promotional purposes (website, social media, portfolio) unless the client opts out in writing prior to delivery.

5. Liability

  • General: We are not responsible for any damage, loss, or injury occurring during the photoshoot.

  • Consequential Loss: We are not liable for indirect or consequential damages.

  • Force Majeure: We are not liable for delays or cancellations caused by circumstances beyond our control (e.g., severe weather, illness, emergencies).

6. Privacy & Data Protection

We value your privacy. Personal information will only be used to provide requested services and will not be shared without consent.

8. Photo Access & Storage

  • Access Period: Clients have 30 days from delivery to download their photos using the link provided. After 30 days, the link will expire and the gallery will no longer be available.

  • Storage Policy: Final images are securely stored for 365 days from your session date. After this period, they will be permanently deleted. To obtain images beyond this time, a new photo session must be scheduled.
